Welcome to Vidsta! These Terms of Service ("Terms") govern your access to and use of the Vidsta website and services provided by Webber D Holdings Pty Ltd trading as Vidsta ("we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
You affirm that you are of legal age to enter into these Terms, or if you are not, that you have obtained parental or guardian consent to enter into these Terms.
Vidsta provides a global video production platform connecting clients with a network of vetted videographers and photographers for the creation of video and photographic content ("Content"). Our Services include, but are not limited to, project management, creator matching, content production, editing, and delivery.

Upon full payment for Services, all intellectual property rights in the final Content delivered to you will transfer to you. We retain a non-exclusive, royalty-free, worldwide license to use the Content for our marketing and promotional purposes, unless otherwise agreed in writing.
All intellectual property rights in the Vidsta platform itself, including software, trademarks, logos, and website content (excluding client-provided content), are owned by Webber D Holdings Pty Ltd trading as Vidsta.
Fees for our Services will be clearly communicated before you commit to a project. You agree to pay all applicable fees as per our agreed payment terms. All payments are processed through secure third-party payment gateways.
Cancellation and refund policies are detailed in your specific service agreement or project proposal. Please refer to those documents for more information.
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Webber D Holdings Pty Ltd trading as Vidsta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services.
You agree to indemnify and hold harmless Webber D Holdings Pty Ltd trading as Vidsta and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia, for the resolution of any disputes.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
